Si descargas por BitTorrent desde un VPS o servidor dedicado, cuidado con el copyright

De un tiempo a esta parte se están intensificando los avisos por descargar material con copyright. Uno de los países de Europa donde más se persigue a los usuarios es en Alemania, y no pienses que, si tienes un VPS o servidor dedicado alojado en Alemania no vas a tener estos problemas, aunque no tendrás que pagar ninguna multa como sí ocurre si lo haces desde tu casa.

Un grupo de amigos tienen un VPS en una conocida empresa de hosting en Alemania para automatizar sus copias de seguridad en la nube. A uno de ellos se le ocurrió la brillante idea de descargar material con copyright desde un tracker BitTorrent público.

En Alemania hay empresas que rastrean todo tipo de descargas de material audiovisual, no importa que el tracker BitTorrent no esté en Alemania o que se usen webs que están en España, rastrean toda la red en busca de este tipo de material. Junto a estas empresas de rastreo, hay “bufetes” de abogados donde por unos cientos de euros se anula la denuncia por infracción de copyright, y si no lo haces, te enfrentas a una multa por más cantidad en la empresa que ha detectado la infracción.

Lo que ocurrió en este caso de descarga en la red BitTorrent, fue que la empresa de hosting envió un email avisándoles de que alguien había realizado descargas con copyright, ya que se lo había notificado la empresa IP-Echelon que se encarga justamente de esto, y que deberían incorporar medidas de seguridad para evitar que volviera a suceder.

Tal y como podéis ver, el hosting pide al usuario que tome las medidas de seguridad oportunas para evitar esto en un futuro. Además, les da un plazo de 24 horas para contestar explicando cómo creen que ha podido ocurrir, y qué medidas van a tomar para que no vuelva a suceder.

Tal y como podéis ver, la empresa IP-Echelon monitoriza continuamente la red BitTorrent para detectar posibles infracciones en suelo alemán, y ni siquiera las empresas de VPS y servidores dedicados se salvan de esto. Otro detalle importante es que el hosting Hetzner tampoco pone muchos requisitos a la hora de contestarles el correo, de hecho, este grupo de amigos ya han recibido más notificaciones por infracción de copyright con la red BitTorrent y no les han cerrado la cuenta ni les han dado un ultimátum.

De hecho, la contestación que les dio al hosting fue bastante laxa, indicando que se ha localizado al usuario que ha descargado por BitTorrent, y que han eliminado el fichero y su cuenta se ha deshabilitado, aunque todo ello no se corresponda con la realidad.

Conclusiones

Aunque las medidas contra los usuarios se están intensificando, e incluso también se está empezando a denunciar a los proveedores de Internet tal y como os cuentan desde ADSLZone.

Actualmente parece ser que los hostings no tienen una política demasiado rígida, como por ejemplo que por descargar material con copyright nos corten el servicio. Aunque si vas a contratar algún VPS o servidor dedicado para estas tareas, mejor que sea en uno donde el país de origen tengan una leyes más flexibles respecto a este asunto para que el hosting no te envíe emails de aviso por infracción.
